Over the course of 40 years representing clients in litigated matters, I have tried and arbitrated numerous disputes to conclusion. One thing is true. Litigation is a time-consuming and expensive undertaking. In many cases, parties spend tens of thousands or even hundreds of thousands in fees and costs without getting the dispute any closer to resolution. For many, the cost of litigation simply becomes prohibitively expensive. Unlike trial or arbitration, mediation provides a fast and less expensive alternative to protracted litigation and discovery. The mediation process allows the parties to have their day in court while at the same time maintaining control of the outcome. Mediation affords the parties a faster and less expensive process to explore resolution.
